Abstract
For some decades, the actions of the Teaching Career Qualifying Court (TCCD) have been the object of accusations for the inadequate application of discretion within the process of awarding teaching positions and school managers in the public sector. Therefore, this article takes up an exploratory investigation on the performance of this ministerial entity in the period 2014-2018. The methodological design implemented was intensive (qualitative); that is, through an inferential analysis, applied mainly to official documents, an attempt has been made to determine the factors that have influenced the proceedings of this court Among the findings can be mentioned gaps in the legislation and the inappropriate use of discretion by the TCCD in the process of assigning places.
